The potential for a suspension is just as bad. In Rhode Island, 5 or more points in a year, 6 or more in 2 years, or 8 or more in 3 years results in a 1 year license suspension. An accumulation of 8 points results in a minimum 10 day suspension, and a subsequent suspension for a mandatory minimum of at least 30 days. An accumulation 12 points results in a license revocation for an indeterminate term. The following points have been assigned for speeding and speed related violations:


  • Three (3) reckless driving offenses within 1 year -12 points
  • More than 20 MPH over the speed limit-8 points
  • 20 MPH over the speed limit-1 to 5 points
  • Reckless or negligent driving-8 points
  • Other violations-1 to 3 points.  

Rhode Island Title 31 § 31-14 contains the speeding statute and prohibition. Other Rhode Island motor vehicle statues are 31-13-4 obey traffic control device, § 31-16, turning and signaling violations, and § 31-15 passing, lane use, and rules of the road violation.


A major traffic trap in Rhode Island has nothing to do with speeding. It focuses on truckers in enforcement of the Pawtucket River Bridge axel and weight limit restriction on Interstate 95. The fine is steep and severe - $3,000.00!

Rhode Island has some of the toughest DUI laws in the country. The penalties include not only large fines and potential jail time, but community service and Rhode Island DWI school.

Rhode Island 1st Offense OUI .08 -.10:

In addition, unlike other states, under Rhode Island Statute § 31-27-2.1 it is a crime to refuse to submit to chemical test (i.e. breath test).  In addition, your privilege to drive is immediately suspended at arraignment. However, because of the harsh law of refusal you are entitled to an immediate independent medical examination whenever you submit to the chemical test. If the police do not allow this to happen the charges may be dismissed.
