Benefits of retaining counsel to fight your Connecticut speeding ticket

The goal in defending a Connecticut traffic ticket is to prevent an insurance increase. Our lawyers do this by negotiating a plea bargain to a lesser charge. This can be accomplished, for example, by pleading guilty to the charge of improper parking, 14-251 or 14-252 from the initial charge of speeding, 14-219 or reckless driving, 14-222.

Connecticut State Police Traffic Enforcement

Proof that the police compete amongst themselves to see who can write more tickets. This was defended by Lt. J. Paul Vance, spokesman for the CSP, as “motivational.”  Who is on your side?

In addition to preventing an insurance increase, when you retain our lawyers we save you time and money in the ease of retaining our services. We go to court for you and e-mail you the retainer agreement. In other words, you never lose money in lost time from work to come to our office or go to court.  Plus, we charge 1 low flat fee.

Special consideration for certain drivers

It is ALWAYS better to fight a speeding ticket or other type of traffic moving violations. However, persons in the below categories should unquestionably fight their traffic infraction:

·         You hold a commercial driver’s license (CDL)

·         You do not hold a CDL but otherwise drive for a living

·         You or a family member is in assigned risk (23 years or younger)

·         You were given a speeding ticket charged with doing 14 MPH or more over the limit

·         You were given more than 1 ticket on the stop

·         You had an accident within the last 3 years

·         You were convicted of a moving violation in any state in the last 3 years

·         Your license is not from the State of Connecticut

·         You were given a ticket because you were involved in an accident

·         You were charged with:

o        Reckless driving, 14-222

o        Following too close, 14-240 & 14-240(a)

o        Evading responsibility & racing, 14-224

o        Running a stop sign, 14-301

o        Running a red light, 14-299

o        Failure to yield, 14-245, 14-246 & 14-247

o        Operating while suspended,  14-215a

o        Speeding in a work zone, 14-212d

o        Speeding in a school zone, 14-212b

o        Uninsured, 14-213(a) & 14-213(b)

o        Striking an officer with a motor vehicle, 14-223(a)

o        Using a MV w/o owner’s permission, 14-229

o        Engaging an officer in pursuit, 14-223

o        Failing to stop for a school bus, 14-279

o        Driving under the influence (DUI / DWI), 14-227a

Benefits of fighting a Connecticut speeding ticket / traffic infraction

Many people believe that because “points” do not accrue to your Connecticut driving record if you plea guilty by mail it is better to do that than fight the ticket. While true that pleading guilty “as charged” the Connecticut DMV will accrual the  points to your driver’s license, it is not the DMV licensing “points” that you are seeking to defeat, but the insurance company’s “merit system” points. However the insurance company’s merit system points, insurance and DMV Point Systems are not the Same.

Difference between insurance “Merit System” and DMV points

Merit Ratings Plans started in the 1930s when states offered a safe driver reward plan. As time went on rather than rewarding good drivers the insurance companies undertook a risk rating plan which penalized drivers for accidents and moving violations. New York State was the first to do this, and by the 1950s all states and insurance companies adopted a risk rating system instead of a safe driver reward plan. Each insurance company uses a complex proprietary rating algorithm, so it is impossible to compare how exactly points DMV points affect your insurance premium.

Contrast the insurance merit system points, in which the DMV points are administered by the Connecticut department of Motor Vehicles. Exceeding your point allowance within a certain time period can result in the suspension of your driver’s license. Moreover, if you are an out of State driver, the State of Connecticut reports the conviction to your home state which could result in your home state accruing DMV points. Indeed, the Connecticut Judicial web site warns of this before you enter a plea of guilty as charged online:

[By] pay[ing] your ticket…[Although]…no points will be assessed…the conviction will appear on your Driver History…if you are an out-of-state driver, your home state will be notified of the case disposition …”

Defending your Connecticut speeding ticket or traffic ticket

If you receive a speeding ticket in Connecticut under Connecticut Motor Vehicle Law 14-218a, 14-219, 14-220, or a ticket for failure to obey a stop sign, 14-301, failure to signal,14-244, improper turn, 14-242, passing a stopped school bus, 14-279, tailgating, `14-240, failure to obey a traffic control signal (running red light), 14-299, or under any section or subsection of Connecticut’s MV Law, your case will be heard in one of the following Connecticut Superior courts listed below. No matter where your speeding ticket is being heard we can represent you.
